The grievance procedure is the mechanism used by the union to address administration violations of the collective bargaining agreement. It provides a process that requires administrators to make a good faith attempt to negotiate a settlement with union officials when disputes arise. If a settlement cannot be reached the union has the option to take the matter before an arbitrator who makes a final and binding decision. “Grievance”, as defined by the Contract: The contract defines a grievance as“ …a complaint, claim, or dispute arising under and during the term of this Agreement. Grievances are limited to matters of interpretation or application of express provisions of this Agreement except those provisions that are specifically excluded from the grievance procedure.” Grievance Steps ------------------------------------------ The grievance procedure provides for a 3-step process: Informal Step: You, with or without a union representative can approach your chair/director or appropriate supervisor and attempt to resolve a grievance. A settlement can be reached provided it is consistent with the collective bargaining agreement. The union’s Contract Implementation Officers are available to assist at this level. Step 1: Written Grievance: If a grievance cannot be resolved at Step 1 level the union can file a written grievance notifying the Associate VP in the Provost’s office of the need to formally meet to resolve the grievance. The union has 60 working days from the date of violation (or the date when the violation was known) to file at the step 1 level. The union’s Grievance Coordinators are available to assist at this level. Step 2: Arbitration: If the Step one grievance cannot be resolved the union can elect to take the matter to arbitration where a final and binding decision is made. The union has 21 working days from the date of the administration responds to the Step 1 grievance to file for arbitration. An arbitrator is chosen from an agreed upon panel to hear the case. His/her decision is final and binding.
